The Penalties for Domestic Violence in Texas

The consequences for domestic violence offenses depend on various factors, including the nature of the alleged incident, the degree of harm suffered, and any prior family violence incidents. 

In Texas, domestic violence is classified under specific categories: 

Domestic Assault

This offense is categorized as a Class A misdemeanor, with penalties including fines of up to $4,000 and imprisonment of up to one year.

Aggravated Domestic Assault

This is a more severe form of domestic violence. The victim has suffered serious injury, and/or a deadly weapon was used or exhibited. This offense is classified as a felony, with penalties ranging from a minimum of two years' imprisonment to a maximum of life imprisonment, along with potential fines of up to $10,000.

Continuous Violence Against the Family

This offense is considered a third-degree felony and carries penalties of imprisonment for 2 to 10 years and fines of up to $10,000. It is important to note that the penalties for continuous violence against the family are in addition to whatever sentence came with each individual charge. 

The Difference Between Domestic Violence and Assault

The distinction between domestic violence and regular assault lies in the relationship between the offender and the victim. Domestic violence is characterized by assault or threats of bodily harm against a family member, household member, or someone with whom the offender has or had a dating relationship. 

On the other hand, regular assault pertains to acts of violence or threats of violence against individuals outside of these specific relationships.

Domestic violence offenses often carry harsher penalties than regular assault due to the emphasis on protecting vulnerable individuals within a family or intimate partner dynamics. For example, while simple assault may be categorized as a misdemeanor, the charge can be elevated to a third-degree felony if there is a history of domestic violence.
